Notice to Students Regarding
the Family Educational Rights and Privacy Act of 1974
In accordance with provisions of Public Law 93-380
as amended (P.L. 93-568), the Family Educational Rights and Privacy Act of 1974, commonly
known as the "Buckley Amendment," notice is hereby given to Central Lakes
College students and their parents as follows:
It is the intention of Central Lakes College to
comply with provisions of this law. The college rules and regulations to implement
compliance procedures are available to interested parties, and may be reviewed during
normal business hours. Students who believe the college is not complying with this law are
hereby informed of their right to file a complaint with the U.S. Office of Education.
Central Lakes College maintains only those
"Educational Records" within the definition of this law which are essential to
the process and procedures required to develop and maintain an accurate academic record
for each student and to support such student accounting needs and requirements as are
imposed by law, state and federal regulations, and college operational procedures. These
records may be found in some or all of the following offices: Enrollment services,
divisional, departmental, major program, student activities and advisors. Subject to
provisions of the college rules, they may be reviewed by students upon request.
This law permits the Central Lakes College to make
public certain "directory information" about students. It is the intention of
the college to do so, within the scope of regular college policies and as may be
appropriate to the normal course of college business and operations. The following
information is regarded to be "directory" type information, and some or all of
it may be made public: Name, address, telephone listing, major field, class schedule,
courses of study, participation in officially recognized activities and sports, weight and
height of athletic teams, age and/or date of birth, dates of attendance, degrees and
awards received, and previous educational programs, and institutions attended by the
student. Any student objecting to his or her directory information being made public must
file notice of such objection with the Admissions or the Records and Registration
departments.
Student Senate
A copy of the student senate constitution is
available in the student senate office at each campus.
Policy on Sexual Harassment and Sexual Violence
Central Lakes College is committed to maintaining
the campus environment as a place free of sexual harassment, sexual violence or harassment
based on sexual orientation. As a matter of policy, the college expressly endorses the
principle of affirmative action and explicitly prohibits all forms of harassment. It is
the responsibility of all persons within the Minnesota State Colleges and Universities
System to work to ensure a safe environment for students and employees. More information
and a copy of the Central Lakes College policy statement is printed in the student
handbook. Handbooks are available in the student service areas on each campus.
Sexual harassment is specifically prohibited by
Title VII of the Civil Rights Act of 1964 and 1991, the Minnesota Human Rights Act and
Title IX of the Education Amendments of 1972 and is punishable under both federal and
state laws.
Security Policy and Campus
Statistics
Federal regulations require Central Lakes College
to maintain and disclose information on campus crime statistics and security policies on
an annual basis. This information is available to students upon request at campus
information centers and in the student services areas on each campus.
Student "Right to Know"
Federal regulations require the college to maintain
and disclose student program completion or graduation rates. This information is available
to students upon request in the student services areas on each campus.
Use of Drugs and Alcohol
The use of alcohol or drugs is strictly forbidden
at all on-campus college functions. Central Lakes College will not give financial support
or promote the sale or serving of alcoholic beverages at any off-campus functions.
Behavior problems resulting from the use of alcohol or drugs at a college function on or
off-campus will be subject to disciplinary action.
Drug Free Policy
According to Public Law 101.226, Central Lakes
College must inform students of its policy concerning drugs. Our policy is as follows:
Students are prohibited from manufacturing,
processing, distributing, and/or using illegal drugs and alcoholic beverages on the
grounds of the college or in the college vehicles. If a student violates this policy,
he/she could be arrested and prosecuted. In addition, the student could be expelled from
the college and lose his/her financial aid.
Because Central Lakes College is concerned about
the health of its students and their ability to learn, we intend to strictly enforce this
policy. However, we also understand that some students may need help with a problem of
drugs or alcohol. If you or a friend have such a problem, you may speak in confidence with
your campus counselor. Your counselor can assist you in dealing with the problem and can
make a referral to sources of additional help.
If you have any questions about this policy, please
contact the Dean of Students or a campus counselor.
ADA Policy
CLC complies fully with the provisions of the
Americans with Disabilities Act of 1990, 42 U.S.C. section 12101, which prohibits
discrimination in employment and public educational services on the basis of an
individuals disability. The ADA Policy is found in the student services areas on
each campus.
Policy for Students with
Disabilities
CLC has a policy for students with disabilities
which states the rights of these students and explains the accommodations available. This
policy is found in the student services areas on each campus.
AIDS Policy
Central Lakes College is committed to providing an
educational program concerning the Acquired Immune Deficiency Syndrome. Students and
employees are encouraged to seek out educational opportunities on campus through classes,
library resources, pamphlets, and workshops to increase awareness about HIV-related
issued.
Guidelines
The following guidelines will be followed when
dealing with persons who have been diagnosed as having AIDS or as being infected with HIV.
1. Unless medical evidence indicates that any
situation would produce an unreasonable risk for the person diagnosed as having AIDS or as
being infected with HIV or for others coming into contact with the person, (1) a student
will be allowed to attend Central Lakes College and participate in CLC activities in an
unrestricted manner and (2) an employee will be permitted to remain engaged in normal work
activity.
2. Central Lakes College will respond individually
to situations involving special concerns or questions.
3. Any decisions regarding the restriction of a
students attendance or participation in activities, or an employees
involvement in work will be made only by the Central Lakes College president. The
president shall make such a decision only after receiving medical advice from the
Minnesota Department of Health and legal advice from the Minnesota Attorney Generals
office.
4. Any decisions negatively affecting a
students college status shall be open to appeal to the chancellor/designee. The
decision of the chancellor/designee shall be final and will be made only after receiving
medical advice from the Minnesota Department of Health and legal advice from the Minnesota
Attorney Generals office.
5. Neither the admissions process nor the hiring
process will involve any required testing or screening.
6. Any information shared with Central Lakes
College officials by students, employees, parents, and medical personnel regarding an
individuals condition shall be absolutely private.
7. Notification of a persons condition shall
be made to no one except those persons officially involved in making recommendations or
decisions involving the particular case.
8. No information regarding a persons
condition shall be entered on (1) the students educational records, or (2) the
employees employment record.
9. Central Lakes College shall provide
"reasonable accommodation" for students and employees who are disabled.
Decisions concerning "reasonable accommodation" should be made on an individual
basis.
Equity in Athletics Disclosure Act
All co-educational institutions of higher education
that participate in any federal student financial aid program (Pell, SEOG, and SSIG
Grants, Work study, Family Education, Perkins, and William D. Ford Director Loans) and
have intercollegiate athletic programs must provide information concerning their
intercollegiate athletic programs under the Equity in Athletics Disclosure Act of 1994,
Section 360B of Pub. L. 103-382. This act and accompanying federal regulations require
that the following information, based on the previous reporting year, be available for
inspection by students, prospective students, and the public by October 1, 1996, and by
October 15 each year thereafter. This information is posted in Counseling & Guidance
office, Mens & Womens Athletic office on the Brainerd campus and in the
Student Senate office at the Staples campus.
Smoke Free Campus
Smoking is not permitted inside any building on the
